Terms of Use

Welcome to LED banner (the "APP").

These Terms of Use (the "TOS") set forth the legally binding terms for your use of the APP, which is developed and operated by Life Assistant Studio ("we", "us", "our" or the "Developer"), contactable at LifeAssistantStudio@outlook.com.

By downloading, accessing or using the APP you agree to be bound by these TOS. We will treat your access to or use of the APP as acceptance of these TOS and of our other policies, in particular our Privacy Policy and our Subscription & Cancellation Policy, in each case in the version we make available in the APP and on the store listing.

If you do not agree with these TOS or any other of our policies, please stop using the APP.

For purposes of the TOS, "you" and "your" means you as the user of the APP.

1. General

LED banner is a mobile application that turns the screen of your device into a scrolling LED sign. You type a message and the APP displays it full screen, with a choice of fonts, text and background colours, gradients, outlines, glow, a dot-matrix "LED bead" effect, scrolling direction and speed, blinking, and portrait or landscape orientation. You can also set a photo or video from your device as the background, play a music track from your device while the banner runs, draw your own artwork and display it instead of text, and save the combinations you like so you can return to them later (together, the "Services").

The APP runs on your device. Everything you create — your message text, drawings, saved styles and settings — is stored in the APP's private storage on your phone and is not uploaded to us. See the Privacy Policy for details.

1.1 No account

The APP does not require you to create an account, sign up or log in. There is no username or password to protect. Your settings and saved styles belong to the installation on your device; if you uninstall the APP, clear its data, or move to another device, they do not follow you.

Purchases are tied to the Google account you used to buy them, not to an account with us. See Section 8 and the Subscription & Cancellation Policy.

1.2 Free version, advertising and paid upgrade

The APP is free to download and use. The free version is supported by advertising, and certain features are reserved for users who have purchased the premium upgrade. Some locked features may also be unlocked once by choosing to watch a rewarded ad; watching is always optional.

Purchasing the premium upgrade or subscription removes advertising and unlocks the premium features for as long as your entitlement is active. All purchases are processed by Google Play — see Section 8.

1.3 Your device and safety

The APP is designed to keep the screen on and, if you enable it, to raise the screen brightness to maximum while a banner is displayed full screen. This is what makes the sign readable, but it also means the APP will use more battery than a typical application and the device may become warm during prolonged use.

Do not use the APP while driving, cycling, or operating machinery, and do not hold it in a way that obstructs your view or the view of others. The APP produces bright, high-contrast, and — if you enable blinking — flashing light. If you or anyone who may see the screen is sensitive to flashing lights or has a history of photosensitive epilepsy, do not use the blink feature. You are responsible for using the APP safely and lawfully in the place where you are.

The APP is not directed to children and is not intended for use by anyone under 13 years of age, or the higher minimum age that applies in your jurisdiction. If we learn that a user is below that age, we may restrict or terminate that user's access.

3. Intellectual property

The APP and everything embedded in it — its design, layout, icons, illustrations, bundled background images and videos, bundled fonts, colour palettes, software and underlying technology — are owned by or licensed to Life Assistant Studio and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the APP on devices you own or control, for your own personal and non-commercial purposes. This licence does not transfer title. It terminates automatically if you breach these TOS, and we may terminate it at any time.

You may not reproduce, extract, redistribute, sublicense or resell the bundled backgrounds, fonts, icons or any other asset of the APP outside of the APP itself.

4. Your content

"Your Content" means the message text you type, the drawings you make, the styles you save, and any photo, video or music track you select from your device for use in the APP.

Your Content stays on your device. The APP does not upload it to us, and we neither see it nor store it. As a result, we do not claim, and do not need, any licence over Your Content.

You are solely responsible for Your Content and for the rights in it. In particular, you represent and warrant that you hold all rights, licences and permissions necessary to use any photo, video, music track or other material you select — including, where the material depicts a person, that person's consent, and, where the material is protected by copyright, the rights holder's permission. Playing a commercially released music track in public may require a separate licence in your country; obtaining it is your responsibility.

Because Your Content is not transmitted to us, we cannot recover it for you. Uninstalling the APP or clearing its data deletes your saved styles, drawings and settings permanently. Please keep your own copies of anything you care about.

5. Restrictions on conduct and content

The APP is a display tool. It shows what you tell it to show, and we do not review, moderate, endorse or take responsibility for the messages, drawings or media you choose to display.

You are solely responsible for what you display and for where and how you display it. You must not use the APP to display material that is unlawful, that infringes another person's rights, that harasses, threatens or defames any person, that impersonates any person or organisation, or that is obscene or otherwise inappropriate for the place in which it is shown.

5.3 Reporting a problem

If you believe the APP itself contains material that infringes your rights, or if you wish to report a problem, contact us at LifeAssistantStudio@outlook.com or use the "Feedback" screen in the APP. Please describe the material, where it appears, and the basis of your claim. We will investigate and, where appropriate, remove or replace the material.

6. Advertising

The free version of the APP displays advertising supplied by our advertising partners. Ads are selected and served by those partners, not by us; their presence in the APP is not an endorsement, and we are not responsible for the content of an ad or for anything you obtain from an advertiser.

Some features can be unlocked once by choosing to watch a rewarded ad. Watching is voluntary. If a rewarded ad fails to load or is interrupted, the reward may not be granted; you may try again, or purchase the premium upgrade instead.

Advertising can be removed permanently by purchasing the premium upgrade. Information about advertising identifiers and your opt-out choices is set out in Section 6 of the Privacy Policy.

7. Third-party services and content

The APP relies on services provided by third parties, including Google Play for distribution and billing, our advertising partners, and analytics and crash-reporting providers. Their availability is outside our control, and we are not liable for their acts or omissions.

The APP may also link to third-party sites, and advertising may take you to a third-party destination. Their presence is not a recommendation. We do not control those destinations, do not guarantee their safety, and assume no liability for any loss arising from them. If you choose to visit one, you do so at your own risk and should review its own terms and privacy policy.

8. Payments

All purchases in the APP are processed by Google Play, using the payment method on file in your Google account. Life Assistant Studio does not collect or store your card number or any other payment credentials.

The APP offers an auto-renewing subscription and a one-time purchase. Prices are shown in your local currency in the APP and on the Google Play purchase screen before you confirm; applicable taxes may be added by Google Play depending on your country. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the end of the current period.

9. Availability and changes to the APP

We may add, change, suspend or discontinue any feature of the APP at any time, and we may stop supporting older versions of the APP or older versions of Android. Where a change would remove a feature you have paid for, Section 7 of the Subscription & Cancellation Policy applies.

We do not guarantee that the APP will be available without interruption or free of defects.

10. Disclaimer of warranties

THE APP IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS AND ITS USE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT AND TITLE.

WE DO NOT WARRANT THAT:

Nothing in these TOS excludes or limits any right you have as a consumer that cannot be excluded or limited under the law of your country of residence.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE, BUSINESS OR DATA, ARISING IN WHOLE OR IN PART FROM YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING ANY LOSS OF SAVED STYLES, DRAWINGS OR SETTINGS, ANY BATTERY DRAIN, OVERHEATING OR SCREEN WEAR RESULTING FROM PROLONGED FULL-BRIGHTNESS DISPLAY, AND ANY CONSEQUENCE OF DISPLAYING A BANNER IN A PARTICULAR PLACE OR SITUATION — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the APP shall not exceed the greater of (a) the amount you paid us for the APP in the twelve months preceding the event giving rise to the claim, and (b) USD 20.

We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control.

12. Indemnity

You agree to indemnify and hold harmless Life Assistant Studio from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these TOS, your violation of any law, or your infringement of the rights of a third party — including any claim arising from material you displayed using the APP.

13. Governing law and disputes

Talk to us first. If something goes wrong, please write to LifeAssistantStudio@outlook.com and give us a reasonable opportunity to put it right before starting any formal proceedings. Most matters — billing and refunds in particular — are resolved fastest this way, or directly through Google Play.

These TOS are governed by the laws of the jurisdiction in which the Developer is established, without regard to its conflict-of-law rules, and the competent courts of that jurisdiction shall have non-exclusive jurisdiction over any dispute arising out of or in connection with them.

Consumers keep their local protection. The APP is distributed worldwide. Nothing in this section deprives you of the protection afforded to you by the mandatory rules of the law of your country of residence, nor of your right to bring proceedings before the courts of your place of residence. Where those rules conflict with this section, those rules prevail.

14. Changes to these TOS

We may update these TOS and our other policies from time to time. The revised version will be made available through the APP, and the "Date of Revision" at the top of this page tells you when it last changed. Changes take effect when published. If you do not agree with a revision, stop using the APP; continuing to use it after a revision means you accept it.

15. Termination

These TOS remain in effect until terminated. You may terminate them at any time by ceasing to use the APP and uninstalling it. We may terminate or suspend your access to the APP, with or without notice, if you breach these TOS.

Termination does not entitle you to a refund except as provided in the Subscription & Cancellation Policy or as required by law. Sections 3, 4, 10, 11, 12 and 13 survive termination.

16. Miscellaneous

If any provision of these TOS is found to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

Our failure to enforce any provision is not a waiver of it. You may not assign these TOS; we may assign them in connection with a transfer of the APP, on notice published in the APP.

These TOS, together with the Privacy Policy and the Subscription & Cancellation Policy, constitute the entire agreement between you and us regarding the APP and supersede any prior agreement on the same subject.
